California Court of Appeal
Garcia v. Holt, 066393
In a premises liability action arising after plaintiff landscaper was injured by explosives maintained by defendants' tenants, the trial court's grant of summary judgment to defendants is affirmed where: 1) defendants did not have actual or constructive knowledge of explosive materials on the premises; and 2) defendants did not have a duty to make reasonable and periodic inspections of the premises once tenants' lease became month-to-month, absent actual or constructive knowledge that an inspection was necessary.
