In a putative class action asserting statutory violations arising from defendant's unlawfully recorded and/or monitored telephone conversations that plaintiff had with defendant's representatives, the trial court's order compelling arbitration of plainitiff's individual claims and dismissal of her class claims is: 1) affirmed as to the arbitration ruling; and 2) reversed as to the portion of the order dismissing the class claims where the parties' agreement delegates to the arbitrator the question of whether class arbitration is available under the contract.
