In an action challenging defendant's county's denial of plaintiff's claim, under Rev. & Tax. Code section 4675(a), for the excess proceeds from the sale of seized residential property that was in default on property taxes, the trial court's dismissal of the action, on grounds that it is time-barred and fails to state a claim for relief, is reversed where: 1) the action is timely; and 2) a recorded grant deed is not the exclusive means of proving a person's title of record, and allegations in the complaint do sufficiently state a claim.
