California Court of Appeal

Uspenskaya v. Meline, C071647

In a case that raises an issue in the evolving body of case law on the calculation of reasonable medical expenses in economic damage awards, the trial court's entry of judgment on a verdict finding defendant negligent and awarding plaintiff past medical expenses are affirmed where: 1) the trial court's Evidence Code section 352 ruling precluding evidence of the MedFin payments was not an abuse of discretion because defendant proffered no evidence to show that the MedFin payments represented the reasonable value of plaintiff's treatment; and the 2) probative value of the evidence was outweighed by the probability that it would create undue prejudice, and there was danger of confusing and misleading the jury.
