San Pasqual Band of Mission Indians v. State of California, B254870
In a consolidated suit by a tribe for lost profits arising from the State of California and the California Gambling Control Commission's refusal to issue the requisite number of gaming licenses that was specified in a Compact governing the tribe's operation of a casino on its land in San Diego County, the trial court's grant of summary judgment to defendants is affirmed over the tribe's claims that the court: 1) misinterpreted the provision that bars money damages as a remedy to either party in any action arising out of the Compact; 2) failed to consider admissible extrinsic evidence relevant to a proper interpretation of the provision; and 3) erroneously resolved disputed factual issues.
