Save Our Big Trees v. City of Santa Cruz, H041136
In an action seeking a writ of mandate directing the city to set aside its amendments to the Heritage Tree Ordinance and Heritage Tree Removal Resolution, which govern the protection and removal of large trees, for failure to comply with CEQA, Pub. Resources Code sections 2100 et seq., the trial court's denial of the writ is reversed where the city had the burden to demonstrate with substantial evidence that the Project falls within a categorical exemption to CEQA.
