Beverly Hills USD v. LA Metro., B256605

In a dispute arising over a tunnel to be constructed under a high school as part of a subway extension project in Los Angeles, the trial court's denial of the School District's and City's petitions for writ of mandate challenging the approval of the tunnel are affirmed where: 1) substantial evidence supports transportation authority-defendant's decision not to recirculate the EIS/EIR, and that the EIS/EIR adequately discussed air pollution and public health impacts; and 2) defendant did not violate the statutory requirements in conducting the transit hearing, the City received a full and fair hearing, and substantial evidence supports defendant's decision and findings of fact in light of the issues tendered for hearing.
