California Court of Appeal
Chand v. Bolanos, A142384
In an action to expunge a city's lien against settlement proceeds for the reimbursement of the cost of emergency medical services provided to plaintiff for injuries suffered when he was struck by a car, the trial court's judgment denying plaintiff's motion to expunge the lien is affirmed over meritless claims that: 1) the authorizing municipal code provision is preempted by state law; and 2) the lien is unenforceable because the City failed to obtain his written consent to it.
