In a malpractice suit against the attorneys who represented the opposing party in an underlying copyright infringement action, in which plaintiff sued her business partner and co-owner of Purposeful Press LLC, here alleging that attorney-defendants had violated the duty of loyalty they owed to plaintiff under the Rules of Professional Conduct based on her status as a 50 percent owner of Purposeful Press, the trial court's denial of defendants' special motion to strike pursuant to Code of Civil Procedure section 425.16 is affirmed where plaintiff's claims did not arise from defendants' protected litigation activities, but rather from their alleged breach of professional and ethical duties that attorneys owe to their clients.
