People v. Marin, B256748

Conviction of felony driving under the influence, among other offenses, is reversed as to the true finding on the strike allegation and on remand, if the prosecution elects to retry the strike allegation, defendant is entitled to a jury trial as to whether in his prior vehicular manslaughter conviction he personally inflicted great bodily injury on a person other than an accomplice, unless in the plea proceeding that resulted in the conviction the defendant waived his right to a jury trial as to such facts and either admitted them or they were found true by the court with defendant's assent.
