People v. Isom, E061024

Conviction of burglary, Pen. Code section 459, based on the underlying crime of forgery, section 470, and possessing methamphetamine, Health & Saf. Code section 11377, is affirmed where: 1) regardless of whether Walmart's right to control its receipts is a property right protected by the forgery statute, the prosecutor also argued the alternate theory of pecuniary injury; and 2) there is sufficient evidence that defendant had the intent to defraud Walmart.
