California Court of Appeal

People v. Douglas, A140279

Conviction of being a felon in possession of a firearm, in violation of Pen. Code section 29800, and admission of a prior prison commitment, section 667.5(b) in exchange for a lower-term prison sentence, are affirmed over claims that the weapon seized from defendant should have been suppressed as the fruit of an unconstitutional detention, where: 1) defendant was on postrelease community supervision (PRCS) and therefore subject to a mandatory search condition; and 2) the officer's knowledge gave defendant an "objectively reasonable belief" defendant was on PRCS, and since that belief also proved to be accurate, the detention was lawful.
