California Court of Appeal

People v. Super. Ct. (Troyer), B263146

In a writ petition challenging the trial court's ruling that granted a criminal defendant's motion, filed before the probable cause hearing, to dismiss a petition seeking to recommit him for an additional term under the Sexually Violent Predator Act (SVPA), Welf. & Inst. Code section 6600 et seq., the People's writ is granted where the alleged deficiencies in the evaluations supporting the petition do not constitute "material legal error" under People v. Superior Court (Ghilotti) (2002) 27 Cal.4th 888.
