In a suit arising out of a commercial lease dispute between a landlord and a thrift store-tenant, the trial court's award of damages to landlord exceeding $25,000 is affirmed over lessor's contention that the case should have remained a limited civil action where, because lessors took the position below that the case had become an unlimited civil action, and the trial court accepted this position by awarding landlord damages in excess of $25,000, lessors are judicially estopped to deny that the case was an unlimited civil action.
