In a petition for writ of administrative mandamus, challenging city-defendant's approval of a non-party's development application, the trial court's sustainment of defendant's demurrer on the ground that petitioner had failed to join an indispensible party, is reversed where the court erred in denying plaintiff leave to amend because the court erroneously found that the 90-day limitations period set forth in Code of Civil Procedure section 1094.6 applied to her action.
