Ina wrongful death action against healthcare defendants, arising from their care and treatment of plaintiff's deceased father, the trial court's grant of defendants' motions for summary judgment is: 1) reversed as to summary judgment for the physician, where the trial court erred in finding the declaration of plaintiff's medical expert insufficient to raise a triable issue of fact on the issue of the standard of care applicable to physicians and surgeons; and 2) affirmed as to judgment for another physician and hospital defendants, where the trial court did not err in finding that plaintiff's medical expert declaration did not raise a triable issue of fact on the standard of care applicable to nurses and hospitals in general.
