California Court of Appeal
L.A. Taxi Cooperative, Inc. v. Independent Taxi Owners Assoc. of Los Angeles, B255909
In a suit among Los Angeles taxi cab companies and organizations for false advertising on the Internet, the trial court's denial of defendant's anti-SLAPP motion, on grounds that the defendants did not meet their burden of showing that the alleged false advertising fell within the purview of Code of Civil Procedure section 425.16, is affirmed where: 1) the court correctly denied the anti-SLAPP motion, as the conduct alleged constituted purely commercial speech; 2) plaintiffs met their burden of demonstrating the applicability of the commercial speech exemption of section 425.17.
