In an action for quiet title, trespass, injunctive relief and declaratory relief brought by a property owner, the trial court's sustainment of demurrer without leave to amend is affirmed where: 1) plaintiffs failed to establish all the elements under Code of Civil Procedure section 771.010, which is fatal to all causes of action; 2) no takings claims were pled or orally argued in the trial court proceedings; and 3) there is no reasonable possibility that the defect in the pleadings can be cured.
