California Court of Appeal

In re Joshua A., D067498

In an a mother's action challenges the finding that her boyfriend did not qualify as a nonrelative extended family member (NREFM) for placement of her son, the juvenile court's order is affirmed where, although it erred as a matter of law when it ruled a parent is not a relative within the meaning of 361.3(c)(2) for purposes of determining NREFM status within the meaning of section 362.7, the court did not abuse its discretion when it determined placement with boyfriend was not in son's best interests, thus notwithstanding boyfriend's status as an NREFM, the court was not required to direct the Agency to complete its evaluation of his home.
