In an appeal by a surety following the forfeiture of a bail bond, the trial court's grant of summary judgment is vacated where the court: 1) entered summary judgment prematurely, before the time for the defendant to appear had elapsed; and 2) erred in denying the surety's motion to set aside on the grounds that it was filed too late.
