In putative class action brought by former employees against their former employer, alleging violations of the California Labor Code, in which employer moved to compel arbitration, the trial court's initial grant of the motion, then reconsider of its order and ultimate denial of the motion, concluding the arbitration agreement at issue is illusory, is affirmed where the delegation clause and the agreement supporting arbitration are both unconscionable and therefore unenforceable under California law.
