People v. Vukodinovich, C074871

Conviction of one count of sexual intercourse, one count of attempted sexual intercourse, Penal Code section 261(a)(1), five counts of oral copulation, section 288a(g), and four counts of digital penetration, section 289(b), all with a person who "is incapable, because of a mental disorder or developmental or physical disability, of giving legal consent," is affirmed over defendant's contentions that these penal laws impinge on his and the victim's rights to privacy and there was insufficient evidence of a lack of legal consent to support these convictions.
