Bermudez v. Ciolek, G049510

In a personal injury case brought by a bicyclist-plaintiff who was injured when defendants collided in their cars, the jury verdict is affirmed where the jury was entitled to conclude that co-defendant slightly exceeded a reasonable speed when he entered the intersection but that his speed was not a substantial factor in causing plaintiff's injuries. Defendant's motion for a new trial is denied, but because $46,175.41 of the judgment is not supported by substantial evidence, the damage award is reduced to to $3,706,793.60, and affirmed as modified.
