California Court of Appeal
Sherman v. Hennessy Industries, B252566
In a suit asserting claims for negligence, strict liability, and loss of consortium against a machine manufacturer, alleging that a brake lining arcing machine made by its predecessor in interest released asbestos dust that caused decedent-plaintiff's mesothelioma, the trial court's grant of summary judgment in defendant's favor is reversed where reports are sufficient to raise triable issues whether the linings emitted asbestos fibers in the absence of grinding activity upon them.
