People v. Contreras, H040903

Sentence conditions of probation for second degree burglary and are: 1) affirmed as to the condition of probation requiring defendant to stay out of all Kohl's stores, where the condition is not unconstitutionally infirm; but 2) reversed and remanded as to the condition prohibiting possession of, use of, or access to a police scanner or surveillance equipment, where this condition is vague and overbroad because it does not provide sufficient notice of what items are prohibited.
