California Court of Appeal

Moore v. City of Lemon Grove, D066670

In a suit brought by a sanitation ratepayer, alleging a city's transfer of funds collected as sewer service fees and charges to the city's general fund violated Proposition 218, the Right to Vote on Taxes Act, the trial court's judgment in favor of defendants is affirmed where the charges at issue were subject to Proposition 218, but the transfers did not violate Proposition 218 as the city sanitation district used reasonable methods to determine the amounts to transfer.
