In an action alleging breach of the insurance policy and insurance bad faith after defendant denied her tender of the defense of a lawsuit brought by nonparty, the trial court's grant of defendant's motion for summary judgment and denial of plaintiff's cross-motion for summary adjudication, are affirmed where the nonparty's claims against plaintiff arise from nonaccidental conduct, outside the terms of the policy.
