Where a union requests the Board to order mandatory mediation and conciliation (MMC) under Labor Code section 1164 et seq., the employer may defend against the MMC request by raising the issue of the union's abandonment of its representative status, including abandonment thereof based on such union conduct as unreasonably lengthy absence and inactivity.
