Tri-Fanucchi Farms v. Agricultural Labor Rel. Bd., F069419
In a farm labor dispute involving a union that did not bargain for 24 years and an agriculture employer's subsequent refusal to bargain based on abandonment theory, the ALJ's decision in favor of the union is: 1) affirmed where the union's lengthy period of inactivity did not defeat employer's duty to engage in bargaining with that union upon request; and 2) reversed where the Board's imposition of make whole relief against employer was not appropriate because employer's pursuit of judicial review of the abandonment issue provided needed clarification on the important legal question affecting labor relations under the Agricultural Labor Relations Act (ALRA), Labor Code section 1140 et seq.
