Salazar v. Thomas, F067831
In a case involving the application of the statute of limitations to a quiet title action that attempts to have a deed of trust declared void as a forgery, summary judgment in favor of defendants on statute of limitations grounds is reversed where the notices of default under a void deed of trust provided notice of a cloud on the plaintiffs’ title, but did not dispute or disturb the plaintiffs' possession of the property, thus the statute of limitations does not bar plaintiff's quiet title action.
