In an eminent domain action in which the proceedings were bifurcated, the trial court's denial of plaintiff-property owners' motion to recover litigation expenses is vacated where: 1) Code of Civil Procedure section 1250.410(a) does not restrict the court to considering only the offer and demand made prior to the first date set for trial; and 2) in a bifurcated proceeding, "the trial on issues relating to compensation" means the trial in which the amount of compensation is determined.
