California Court of Appeal
People v. Shamblin, E059714
Conviction for first degree murder is affirmed where: 1) there was sufficient evidence to support the conviction under either of the prosecution’s theories premeditated and deliberate murder or felony murder; 2) the trial court did not err in admitting post-Miranda statements he made during a police interview and during the booking process; and 3) the trial court did not err responding to the deliberating jury's note seeking clarification on the difference between first and second degree murder.
