Indeterminate life sentence imposed under the Three Strikes Reform Act, following a guilty plea to possession of a a fraudulent check and a forged driver's license, is reversed where the trial court erred in relying on evidence underlying dismissed counts in assessing defendant's eligibility for resentencing, counts on which defendant was neither convicted nor had sentence imposed.
