Golden State Water Co. v. Casitas Municipal Water Dist., B255408
In a case in which city residents voted to oust a private water district and force the sale of its assets to the replacement municipal water district, the trial courts judgment in favor of the city is affirmed where: 1) the Mello-Roos Act can be used to finance eminent domain actions to acquire intangible property, regardless of whether the seller consents to the sale or is compelled under force of law; and 2) financing the acquisition of intangible property incidental to the real or tangible property being purchased is consistent with the Act's text and purpose.
