In an action challenging California Code of Regulations, title 10, section 2695.183 (Regulation) which is related to the underwriting of homeowner insurance, specifically the replacement coverage in the event of a covered event like a fire, the trial court's judgment declaring the Regulation invalid is affirmed where the Insurance Commissioner does not have authority to promulgate the Regulation under authority delegated to him by the Unfair Insurance Practices Act (UPIA), Insurance Code sections 790-790.15.
