East West Bank v. Rio School District, B238618A

In this case arising from a contract for the construction of a school, the trial court entered judgment in favor of plaintiff contractor and assessed penalties against defendant school district because it did not timely release retained funds required by Public Contract Code section 7107. The judgment is affirmed, where: 1) a dispute over the contract price does not entitle a public entity to withhold funds due a contractor; and 2) the doctrine of unclean hands does not apply to section 7107.
