Heating v. CA Dept. of Health Care Services, H040220
Plaintiff trustee of a Special Needs Trust appeals from an order requiring the trust to reimburse defendant California Department of Health Care Services (DHCS) for medical expenses that the DHCS and paid in behalf of the trust beneficiary before death. Plaintiff contends that the trust assets were exempt from the DHCS’ reimbursement rights because the beneficiary was under 55 years of age when the services were provided. The order is affirmed, where the DHCS was entitled to reimbursement of the medical expenses it paid under both the federal Medicaid statutes and the statutes and regulations implementing Medicaid through Medi-Cal.
