Watts v. Oak Shores Community Association, B240337
Plaintiffs brought this action challenging regulations and fees adopted by defendant homeowners association that affect short-term rentals of condominium units. Plaintiffs are absentee owners who rent their homes to short-term vacation renters. Judgment in favor of defendant is affirmed, where: 1) the association has the authority to enact reasonable regulations governing transfers so as to preserve the owner's quiet enjoyment of the premises and the maintenance of security, and here there is more than ample evidence that short-term rentals have significant impacts on the enjoyment of the premises by other owners or on security; and 2) the evidence established a "reasonably close" relationship between each contested fee and the cost it is intended to offset, and this relationship satisfies former Civil Code section 1366.1.
