Trilogy at Glen Ivy Maintenance Association v. Shea Homes, Inc., D066483

Plaintiff Homeowner's Association and various homeowners filed this action against defendants alleging that defendants improperly diverted revenues from a contract that should have been paid to the Association. After defendants obtained judgment on the pleadings, plaintiffs filed an amended complaint and defendants responded by moving to strike the amended complaint pursuant to the anti-SLAPP statute (Code of Civil Procedure section 425.16). The trial court's order denying defendants' anti-SLAPP motion is affirmed, where the trial court correctly found that defendants had not satisfied their initial burden of showing plaintiffs' claims arose from protected activity and therefore correctly denied defendant's motion to strike the complaint under section 425.16.
