California Court of Appeal

Alterra Excess and Surplus Insurance Company v. Estate of Buckminster Fuller, A140453

In this case, defendant Estate of Buckminster Fuller appeals from a judgment on the pleadings holding that plaintiff insurance company had no duty to defend, and therefore no duty to indemnify, its insured in an underlying intellectual property action brought by the Estate against the insured. The judgment is affirmed, where an exclusion in the insurance company's policy, known as the "intellectual property" exclusion, applied to preclude any obligation on their part.
