Windsor Food Quality Company v. The Underwriters of Lloyds of London, E058324

In this case, plaintiff manufactured frozen food products using ground beef supplied by Westland. Following a voluntary recall of Westland beef, plaintiff made a claim under its Contamination Products Insurance policy, issued by defendants. After defendants denied coverage, plaintiff sued for breach of contract and bad faith. Summary judgment in favor of defendants is affirmed, where: 1) plaintiff cannot claim coverage for the recall of Westland's ground beef; and 2) there are no disputed material facts and there was no bad faith involved in the denial of coverage.
