City of Los Angeles v. Superior Court of Los Angeles, B250805

In this case, plaintiff-tenant lived alone and was evicted by his landlord after the City determined that his unit was an illegal rental. Plaintiff asserts that he has an orthopedic disability that impairs his personal mobility, and that he is entitled to an enhanced relocation assistance sum of $18,300 as a "qualified tenant" under California Health and Safety Code section 50072. The judgment in favor of plaintiff is vacated, where, under the plain language of section 50072, only a head of household with an orthopedic disability is deemed to be handicapped, but because plaintiff is a single person he is therefore not a "qualified tenant."
