In an insurance action to recover sums plaintiff expended in settlement of a personal injury claim allegedly resulting from, among other things, material and design defects present in a tire manufactured by Yokohama and sold by Costco to a plaintiff in the underlying case, the trial court's judgment in favor of the manufacturer and its insurer is reversed where: 1) the trial court erred in excluding relevant and material expert evidence on a matter properly subject to expert opinion; but 2) the bad faith cause of action is dismissed, as the trial court properly sustained Tokio Marine's demurrer to a bad faith cause of action contained in an earlier pleading.
