Los Angeles Memorial Coliseum Commission v. Insomniac, Inc., B252838

In this case, plaintiffs Los Angeles Memorial Coliseum Commission and Los Angeles Memorial Coliseum Association allege that defendants paid an employee of the Commission for services related to those music events staged at the Coliseum and that such payments were inappropriate and not disclosed to plaintiffs. Dismissal is reversed and remanded, where: 1) plaintiffs adequately stated causes of action under the conflicts of interest prohibition in Government Code section 1090, conspiracy to defraud, violation of the Unfair Competition Law, and accounting; and 2) the trial court properly sustained without leave to amend defendants' demurrers to the causes of action for violation of the False Claims Act, fraud, and negligence.
