In this case arising from a contract for the construction of a school, judgment in favor of plaintiff contractor is: 1) reversed in part, where the trial court properly assessed penalties against defendant school district because it did not timely release retained funds required by Public Contract Code section 7107, as a dispute over the contract price does not entitled a public entity to withhold funds due a contractor; 2) reversed in part, where the trial court erred in awarding fees for work not solely related to plaintiff’s cause of action pursuant to section 7107; and 3) affirmed in all other respects.
