California Court of Appeal

People v. Perez, G049041

In this case, defendant pled guilty to possessing methamphetamine for sale and possessing a firearm within 1000 feet of a school. The denial of defendant’s timely filed motion to withdraw his guilty pleas, without stating any reasons for the denial, is reversed and remanded, where: 1) the court neither found that the declarants lacked credibility nor that the evidence had been in dispute; and 2) an order denying relief without any statement of a reason provides no reasonable basis for the denial.
