Bertoli v. City of Sebastopol, A132916

In this California Public Records Act (PRA) litigation, plaintiffs were attempting to obtain copies of relevant emails or other electronically stored data contained on the hard drives of past and present City officials and employees. The trial court's order finding plaintiffs' PRA litigation "clearly frivolous" and awarding costs and attorneys fees to defendant City and other respondents is reversed, where, despite the fact that the PRA request was unfocused, nonspecific, unduly burdensome, and an invasion of privacy rights, under the circumstances of this case the court's "clearly frivolous" finding should not stand.
