In this putative class action, plaintiff alleges that defendant-business violated the Credit Card Act (Civil Code section 1747 et seq.) by recording his birth date into their computer system when he purchased alcohol with his credit card. Dismissal is affirmed, where the prohibition against recordation of personal identifying information in connection with a credit card transaction does not apply to the purchase of an alcoholic beverage under the plain language of sections 1747.08(a) and 1747.08(c)(4).
