California Court of Appeal
Donahue Schriber Realty Group v. Nu Creation Outreach, F068287
Order enjoining defendants from soliciting charitable donations or engaging in other expressive activities on sidewalks adjacent to store entrances in plaintiff's shopping center, but permitting defendants to engage in such activities in the public forum area of the shopping center, is affirmed, where: 1) there was no error in the trial court's determination that the store entrances and apron areas were not public forum areas in which plaintiff was obliged to permit members of the community to exercise their liberty of speech rights under the California Constitution; and 2) plaintiff adequately demonstrated a potential loss of customer goodwill.
