Koval v. Pacific Bell, A139570

In this class action suit brought against defendant employer for allegedly violating California law by failing to relinquish control over plaintiffs’ activities during meal and rest break periods, denial of class certification is affirmed, where: 1) plaintiffs failed to show that defendant’s allegedly restrictive policies had been consistently applied to the putative class members; and 2) because common questions do not predominate over individual questions, the class action procedure is an inappropriate method for resolving this dispute.
